Mina’s Photo Contract/ Terms
By allowing a child to participate in photography with Mina’s Photo, LLC, the parent or legal guardian agrees to the following terms.
Parent/Guardian Consent
I confirm that I am the parent or legal guardian of the participating child, or that I have legal authority to give permission for the child to participate.
I give Mina’s Photo permission to photograph my child during the scheduled photography session, event, mini session, headshot event, team photography experience, or other photography activity.
Photography & Artistic Style
I understand that photography is a creative and artistic service.
Mina’s Photo will make reasonable efforts to provide photographs consistent with its current style, portfolio, and quality of work. The photographer has final creative control over posing, lighting, composition, image selection, editing, and overall artistic presentation.
Specific poses, expressions, photographs, or results cannot be guaranteed.
Image Delivery
When photographs are included with or purchased from the photography experience, edited images may take up to 8 weeks to be delivered.
Images will generally be delivered through an online viewing gallery.
Online galleries may remain available for approximately 8 weeks from the date of delivery. Parents/guardians are responsible for downloading included or purchased images and placing any desired print or product orders before the gallery expires.
Additional fees may apply if an expired gallery must be reopened, restored, re-uploaded, or retrieved.
Digital Images, Prints & Products
Unless specifically stated as included, digital images, prints, and products may be sold separately through the online gallery.
All sales are final.
RAW or unedited images will not be released.
Copyright & Image Rights
All photographs remain the copyrighted property of Mina’s Photo.
Parents/guardians may use purchased or provided images for personal use, including personal printing and social media sharing.
Images may not be sold, commercially published, or used to promote another business without prior written permission from Mina’s Photo.
Photographs should not be significantly altered, filtered, retouched, AI-edited, cropped in a way that changes the intended presentation, or otherwise modified in a way that may misrepresent the photographer’s finished work.
Mina’s Photo is not responsible for the quality or color accuracy of prints ordered through outside printing companies.
Promotional Use by Mina’s Photo & For the Kidz Gymnastics
By allowing your child to participate, you give permission for photographs of your child to be used by Mina’s Photo, LLC and For the Kidz Gymnastics for promotional and marketing purposes.
This may include use on:
- Social media
- Websites
- Printed marketing materials
- Advertisements
- Event promotions
- Displays
- Portfolio materials
- Competition or editorial use
- Other promotional content related to Mina’s Photo or For the Kidz Gymnastics
Photographs may be shared between Mina’s Photo and For the Kidz Gymnastics for these approved purposes.
Mina’s Photo will make reasonable efforts to respect the intended use of the photographs; however, once photographs are provided to For the Kidz Gymnastics, Mina’s Photo cannot control the exact placement, wording, context, or future use of those images by the gym.
Other Vendors
When other approved vendors contribute to the photography experience, such as venues, stylists, makeup artists, florists, or participating organizations, Mina’s Photo may provide photographs to those vendors for appropriate promotional use and credit.
If photographs are shared with another vendor, Mina’s Photo cannot fully control how that vendor uses the photographs after they are provided.
Child Preparation & Participation
Parents/guardians are responsible for making sure their child arrives dressed appropriately, comfortable, fed, rested, and prepared to participate.
Children who are tired, hungry, uncomfortable, or unwilling to participate may not cooperate as expected, and Mina’s Photo cannot guarantee specific photographs or expressions.
Any personal props requested for the photography experience are the responsibility of the parent/guardian unless otherwise stated.
Parent/Guardian Responsibility
The parent or guardian remains responsible for supervising the child before, during, and after the photography experience unless otherwise specifically arranged.
Mina’s Photo may stop, shorten, or modify photography if continuing would create an unsafe, disruptive, or inappropriate situation.
Accessibility
When photography takes place at Mina’s Photo / MI Studio Space in Wayland, Michigan, please be aware that the studio is located on the second floor and does not have an elevator.
If your child or family requires assistance or an accommodation that may reasonably be provided, please contact Mina’s Photo in advance.
Photographer Rescheduling
If the photographer becomes ill, injured, or otherwise unable to provide the scheduled services, Mina’s Photo may offer a rescheduled photography date.
If a paid photography service cannot reasonably be rescheduled, Mina’s Photo may provide an applicable refund for the affected service.
Image Loss or Technical Failure
Mina’s Photo uses reasonable methods to protect photographs from loss, theft, damage, or technical failure.
In the unlikely event that photographs are lost, destroyed, corrupted, stolen, or otherwise unavailable due to circumstances within or beyond Mina’s Photo’s control, liability is limited to the amount paid for the affected photography service.
Mina’s Photo is not responsible for unauthorized access, sharing, copying, or distribution of photographs by third parties after the images have been delivered or lawfully shared.
Limitation of Liability
Mina’s Photo is not responsible for indirect, incidental, or consequential damages arising from participation in the photography experience or from the use or distribution of photographs.
In all circumstances, Mina’s Photo’s financial liability is limited to the amount paid for the affected photography service.
Agreement
By registering a child, submitting a participation form, checking the agreement box, paying any applicable photography fee, or allowing the child to participate in photography with Mina’s Photo, the parent or legal guardian confirms that they have reviewed and agree to these terms.
These terms are governed by the laws of the State of Michigan.
If any portion of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.
